Absolute Network Services terms of use

These Terms of Use along with Terms of Service (collectively, the “User Agreement“) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“You/User”) and Absolute Network Services (ANS) a travel company existing in India, concerning your access to and use of www.absolutenetworkservices.com (the “Site”), including the mobile site, Mobile App including but not limited to iOS/Androd.

ANS is a travel website owned and operated by Absolute Network Services from India, herein after referred to as (“Absolute Network Services”, “we”, “us” or “our”)

You agree that by accessing or using the site or by using the service on the site, you have read, understood, and agree to be bound by all of these Terms of Use.

When you access any sub-site, webpage, hyperlink (whether belonging to an ‘associate’ of Absolute Network Services or otherwise) through this site, then such sub-site may have its own terms of use which is specific to such sub-site, webpage, hyperlink. The sub-sites, webpage, hyperlink may contain such additional terms of use as may be set out in such sub-sites, webpage, hyperlink.

We may add to, change or remove any part of these Terms of Use at any time, without notice.

Absolute Network Services acts as an “Intermediary” solely to assist customers in gathering travel information, determining the availability of travel-related products and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for facilitating travel requirements. You acknowledge that Absolute Network Services merely provides intermediary services in order to facilitate services to you. Absolute Network Services is not the last mile service provider to you and therefore Absolute Network Services shall not be deemed to be responsible for any lack or deficiency of services provided by any person or entity including airline, or similar agency).

ELIGIBILITY

The site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to register for the site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the site.

By using this website, you represent and warrant that:

1. You possess the legal authority to create a binding legal obligation and enter into these Terms of Use.

2. All registration information you submit will be true, accurate, current, and complete

3. You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site.

4. You will use this Website to make only legitimate reservations for you or for another person for whom you are legally authorized to act.

5. You will provide your proper and accurate Name (as per Passport or any other official ID), Email ID, and Mobile Number. You will be solely responsible for the Information provided and in case of any error or mistake in provision of information, Absolute Network Services will not be liable for the same.

6. You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.

7. You will not use the Site for any illegal or unauthorized purpose.

8. Your use of the Site will not violate any applicable law or regulation.

9. if you have an online account with this Website, you will safeguard your login details – username and password and will supervise the same. You will be completely responsible for any use or misuse of your account by you and anyone other person other than you.

10. Upon transacting on the Site, you will receive an e-mail from Absolute Network Services informing the status of your transaction. The e-mail will be sent to e-mail address provided by you and Absolute Network Services is not responsible towards the receipt of the said e-mail in your inbox. You will have to take due care and caution. You are responsible for entering the proper and accurate contact details including your name (as per Passport), email ID to ensure that we and the Airline (Supplier) can effectively communicate with you.

Site and its Content

1. This Site is only for your personal use. You shall not copy, license, adapt, distribute, exchange, modify, sell or transmit any content or material from this Site, including but not limited to any text, images, audio, video or links for any business, commercial or public purpose.

2. You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

3. Absolute Network Services grants you a non-exclusive, non-transferable, limited right to enter, view, use and transact on this Site. You agree not to interrupt or attempt to interrupt the operation of this Site in any way. Access to certain areas of the Site may only be available to registered members. To become a registered member, you may be required to answer certain questions and provide certain details. Answers to such questions and details is mandatory. You represent and warrant that all information you supply to us, about yourself, and others, is true and accurate.

4. You also understand that Absolute Network Services cannot and does not guarantee or warrant that files available for downloading through the Site will be free of viruses, worms or other code that may be damaging. You are responsible for implementing procedures to satisfy your particular requirements and for accuracy of data input and output.

5. This site is for consumer use only. Any travel agent/tour operator/consolidator/aggregator should not use this site for individual/group bookings. In the event of bookings by any travel agent/tour operator/consolidator/aggregator through the Site are detected, Absolute Network Services reserves the right, including without limitation, to cancel such bookings immediately without any notice to such travel agent/tour operator/aggregator/consolidator and/or to withhold payments/commissions thereto. The various discounts and offers mentioned on the Site are applicable to the Consumer for the purposes of end use only.

6. You cannot use the Content and materials on this Site, including but not limited to audio, images, software, text, icons for any purpose.

PROHIBITED ACTIVITIES

As a User of the Site, you agree not to:

1. Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

2. Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means.

3. Use the Site to advertise or offer to sell goods and services.

4. Engage in unauthorized framing of or linking to the Site.

5. Trick, defraud, or mislead us and other Users, especially in any attempt to learn sensitive account information such as User passwords.

7. Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.

8. Attempt to impersonate another User or person or use the username of another User.

12. Use the Site in a manner inconsistent with any applicable laws or regulations.

13. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

14. Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another’s computer.

15. Use this Website or its contents for any commercial purpose.

16. Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;

GUIDELINES FOR REVIEWS

We may provide you areas on the Site to leave reviews, comments or feedbacks. When posting a review, you must comply with the following criteria:

1. you should have first-hand experience with the Product / service being reviewed.

2. your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language.

3. your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.

4. your reviews should not contain references to illegal activity.

5. you should not be affiliated with competitors if posting negative reviews.

6. you should not make any conclusions as to the legality of conduct.

7. you may not post any false or misleading statements

8. you may not organize a campaign encouraging others to post reviews, whether positive or negative.

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners.

We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review.

Visa Guidelines

Please carry a valid visa for the country you will be visiting or transiting through. Please check with the concerned airline and embassy for concerned Visa requirements, Absolute Network Services won’t be responsible if you are denied to travel or board failing to have proper travel documents.

Absolute Network Services Rights

1. If you send any communications or materials to the Site by electronic mail or otherwise, including any comments, data, questions, suggestions or the like, all such communications are, and will be treated by Company, as non-confidential.

2. Any material submitted to this Site may be adapted, broadcast, changed, copied, disclosed, licensed, performed, posted, published, sold, transmitted or used by Company anywhere in the world, in any medium, forever.

3. If your booking or account shows signs of fraud, abuse, or suspicious activity, Absolute Network Services may cancel any travel or service reservations associated with your name, email address, or account, and close any associated Absolute Network Services accounts.

4. Absolute Network Services reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of Absolute Network Services systems remain well-protected. Towards this end, Absolute Network Services may take various steps to verify and confirm the authenticity, enforceability and validity of orders placed by you.

5. If Absolute Network Services, in its sole and exclusive discretion, concludes that the said transactions are not or do not reasonably appear to be, authentic, enforceable or valid, then Absolute Network Services may cancel the said orders at any time up before the scheduled time of departure of the relevant flight booked through Absolute Network Services.

TRANSMITTED MATERIAL

1. Internet transmissions are never completely private or secure. You understand that any message or information you send to this Site may be read or intercepted by others unless there is a special notice that a particular message (for example, credit card/debit card/bank information) is encrypted (send in code). Sending a message to Absolute Network Services does not cause Absolute Network Services to have any special responsibility to you.

2. Copying of part or all the contents of this Site without permission of Absolute Network Services is prohibited except to the extent that such copying/printing is necessary for the purposes of availing of the services.

Disclaimer and No Warranties

1. The material in this Site could include technical inaccuracies or typographical errors. Absolute Network Services may make changes/modifications or improvements on the Site at any time.

2. You acknowledge that Absolute Network Services is an intermediary and is not liable for any 3rd party (suppliers) obligations due to rates, quality, and all other instances, whether to any such subscribers or otherwise. You expressly agree that use of the services and the site is at your sole risk. It is your responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and other information provided through the site or on the internet generally. We do not warrant that the service will be uninterrupted or error-free or that defects in the site will be corrected.

3. The materials on this site are provided and “as available,” “with all faults” basis and without warranties or representations of any kind either expressed or implied.

4. Information, software, products, and services contained on this website, and the inclusion or offering of any products or services on this website does not constitute any endorsement or recommendation of such products or services by Absolute Network Services.

Absolute Network Services does not warrant that the functions contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the servers that make it available are free of viruses or other harmful components, but shall endeavour to ensure your fullest satisfaction.

Absolute Network Services does not warrant or make any representations regarding the use of or the result of the use of the material on the site in terms of their correctness, accuracy, reliability, or otherwise, insofar as such material is derived from other service providers such as airlines, hotel owners and tour operators.

7. You acknowledge that this Website is provided only on the basis set out in these terms of use. Your uninterrupted access or use of this Website on this basis may be prevented by certain factors outside our reasonable control including, without limitation, the unavailability, inoperability or interruption of the Internet or other telecommunications services or as a result of any maintenance or other service work carried out on this Website. Absolute Network Services does not accept any responsibility and will not be liable for any loss or damage whatsoever arising out of or in connection with any ability/inability to access or to use the Site.

LIMITATIONS OF LIABILITY

In no Event will we or our Owners, or Employees be liable to you or to any other person for any direct, indirect, incidental, punitive or consequential loss, damage, cost or expense of any kind whatsoever and howsoever caused from out of your usage of this Site.

GENERAL PROVISIONS

1. You may book travel on ANS to travel to certain destinations which involve greater risks than others, entirely at your risk as to cost and consequences.

2. Absolute Network Services requests you to consult local authorities and evaluate travel prohibitions, warnings, announcements, and advisories issued by them before booking travel to certain international destinations.

3. By offering for sale travel to particular destinations, Absolute Network Services does not represent or warrant that travel to such point is advisable or without risk. Absolute Network Services does not accept liability for damages, losses, or delays that may result from improper documents for entry, exit, length of stay, or from travel to such destinations.

4. Absolute Network Services reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any material posted herein, in any respect. Absolute Network Services shall have no obligation to take the needs of any User into consideration in connection therewith.

5. Absolute Network Services reserves its right to deny in its sole discretion any user access to this Site or any portion hereof without notice.

6. Absolute Network Services is not responsible to provide information on any change in flight schedules, cancellation, status of airline/hotel etc.

7. Reservations are not considered confirmed, until ticketed. Fares are dynamic in nature and probabilities of change in them exist. We will contact you if this happens. You can either receive a full refund of the order or pay the fare difference between the original fare and the new fare for issuing the tickets.

8. Absolute Network Services retains the right in its sole discretion to deny access to anyone to this site or to a section of the site and the services we offer, at any time without notice and for any reason, including, but not limited to, for violation of these Terms of Use.

PROMOTION CODES

• Absolute Network Services offers promotion codes from time to time which may be availed on the Site as a discount coupon. Users are advised that the promotional offer of using Promotion Codes for receiving discounts can be availed only if correct and full details (of the promotional code) are filled in at the time of making the booking. In case if the customer fails to enter the promo code before making the booking, the company shall not be liable to give any credit to the customer after the booking has been made.

• Considering there are multiple promotional offers running on the site, user can avail the benefit of only one offer at a time. No two promotional codes can be combined at the time of making a booking.

• Promotional discounts are applied only on the base amount. Discounts are not applicable for any additional components including taxes.

UNUTILISED TRAVEL BOOKINGS

• The User shall request Absolute Network Services for any refunds against the unutilized or 'no show' air booking for any reasons within 30 days from the date of departure for the air ticket. Any applicable refunds would accordingly be processed as per the defined policies of Airlines, and Absolute Network Services as the case may be. No refund would be payable for any requests made after the expiry of 30 days as above and all unclaimed amounts for such unutilized or no show air booking shall be deemed to have been forfeited.

USER DATA

We will maintain certain data that you transmit to the Site for the purpose of managing the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site.

You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

GOVERNING LAW

This User Agreement and your use of the Site are governed by and construed in accordance with the laws of India and the Parties shall refer any unresolved disputes to the exclusive jurisdiction of courts in Imphal.

Grievance Policy

Absolute Network Services strongly believes in a genuine and transparent approach to its users. You trust and love us and we would never put growth before trust. This policy document aims at minimizing instances of customer complaints, grievances and disappointments via channelized approach, review and remedy.

You can file a grievance / share feedback if you are disappointed with the services rendered by Absolute Network Services or any other issues. You can give your grievance / feedback through email ([email protected]) or by filling the Feedback form online.

In order to make Service channels more meaningful and effective, a structured system has been put in place. This system will ensure that the complaints are redressed seamlessly and well within the stipulated timeframe.

• If the resolution you received does not meet your expectations within 72 hours of receipt of Level 1 grievance, please write to us at [email protected] along with the Booking ID

You should write your Booking ID provided at the time of booking in all further communication with us regarding a particular issue. This enables us to help to resolve the grievance faster.
